Partner terms: independent contractor agreement
This agreement is between Maren Technologies LLC d/b/a Websites Fast (Missouri charter LC014751754; fictitious name WEBSITES FAST, charter X001894400), 807 Lewis Dr, Seneca MO 64865, rob@getwebsitesfast.com (“Maren”, “Websites Fast”, “I”, “me”), and you, the independent sales partner (“Partner”, “you”). It starts when you sign up at preview.getwebsitesfast.com/join and get a partner code. Sending a referral after that means you accept it. Maren can switch a code off at any time. The program is not open to sellers in California.
1. Independent contractor
- You are an independent contractor of Maren. You are not an employee, agent, partner, joint venturer or franchisee, whatever this program is called.
- You control your own hours, methods and leads. You choose who to approach, when, where, how often and how, and whether you work at all. Maren sets no schedule, quota, territory, lead list, call count, script or reporting duty.
- The sales kit, sample pitch, objection answers and sample sites are optional resources. You may use them, change them or ignore them.
- The only requirements on how you sell are that you follow the law and sections 6 and 7 below: follow the Texas face-to-face rule in section 7, disclose the commission, no spam, and no promises the site does not make.
- You supply your own phone, vehicle, tools and advertising, and pay your own costs. Maren does not reimburse expenses.
- You are free to sell other products and services, including for other companies.
- Maren provides no wages, benefits, insurance, training requirement or tax withholding. You are responsible for your own taxes and any business licence your city or state requires.
- You have no authority to sign anything, accept payment, or make any promise for Maren.
2. Commission
- Paid in full. $100 USD when a Qualified Sale is paid as $500 in full.
- Split payment. $50 USD when the $200 deposit on a Qualified Sale clears, and $50 USD when the $400 balance on that sale clears.
- Qualified Sale. A new buyer with no website pays Maren either $500 in full or the $200 deposit, with your partner code entered in the Partner code field at checkout, and the payment clears in Stripe.
- Balance never paid. If the balance is never paid, you keep the first $50 and the second $50 is not owed.
- Not commissionable. Rush fees, change rounds, maintenance plans, extra pages; your own business or one you own part of; a business that paid Websites Fast before; a buyer who was already in contact with Maren before your referral. If two partners claim one buyer, the code on the checkout decides it. If there is none, Maren decides.
- Price. Your commission comes out of Maren’s share. The buyer pays the published price, the same as every other buyer. You may not charge the buyer anything yourself.
3. Payout timing
- When. Each commission is paid 48 hours after Maren receives the buyer’s payment.
- Method. Bank transfer from Maren to a US account in your name.
- Statement. Each payout lists the buyer and payment date it covers.
4. Clawback
If the buyer gets a refund or a chargeback within 120 days of a payment, the commission on that payment comes back. Maren takes it out of your next commission, or you repay it. If Maren wins the chargeback dispute, you get the commission again. A payment made with a stolen card or false details is never a Qualified Sale, and any commission paid on it comes back.
5. Tax forms
- W-9 first. You send Maren a completed IRS Form W-9 before your first payout. No commission is paid until Maren has it.
- 1099-NEC. Maren files Form 1099-NEC and sends you a copy when the law requires it.
- All commission is taxable income to you whether or not a 1099 is issued.
6. Disclosure
You must tell every prospect, clearly and before they pay, that Websites Fast pays you a commission if they buy. Put it next to the link or say it during the pitch, not in fine print or a profile bio. The approved line is: “Heads up, Websites Fast pays me a commission if you buy through my link.” This follows the FTC’s Endorsement Guides. If you post about Websites Fast anywhere, the disclosure goes in the post itself. Maren may review partner posts and messages and ask you to fix or remove one.
7. No spam and conduct
- Sell in person, by phone, text, DM or email. Follow the telemarketing and anti-spam laws where you and the business are. In Texas, a call or text can only set a meeting; the pitch and the sale happen face to face.
- Only pitch businesses that have no website.
- No bulk or automated email, texts or calls. No bought or scraped lists. No messages to anyone who has said no.
- No posting where the community or platform rules ban promotion.
- Say only what getwebsitesfast.com says. No discounts, free work, deadlines, guarantees or results that the site does not state.
- Do not say you are employed by Maren or Websites Fast, or that you are Rob. You may say you are an independent partner.
- Do not call a preview site a client. Do not use the notes form on a preview site. Do not contact any business Websites Fast tells you is off-limits.
- Do not bid on “Websites Fast” or “getwebsitesfast” in search ads, or register a domain or social account using those names.
Breaking this section ends the agreement at once, and commissions on sales tied to the breach are not paid.
8. Ending the agreement
Either side can end this at any time by email. Commissions already earned on Qualified Sales made before the end date are still paid on the schedule above, subject to clawback. Your partner code is switched off on the end date.
9. Changes
Maren can change the commission or these terms by email. Changes apply only to sales made after we email you the change.
10. Law and limits
This agreement is governed by the laws of the State of Missouri. Maren’s total liability to you under it is limited to commissions earned and unpaid.
